County Process / Terms & Conditions

In such counties, purchasers at tax sales must present to the sheriff or constable conducting the sale a written statement issued to the purchaser by the county tax assessor-collector stating that the purchaser owes no delinquent property taxes to the county and that there are no known or reported delinquent taxes owed by the purchaser to any school district or city with territory in the county. State law further prohibits the sheriff or constable in such counties from delivering a tax deed to any purchaser who fails to present to the officer the required written statement issued by the county tax assessor-collector. Listings are advertised three times prior to the auction in a newspaper published in the county where the property is located. 

WHEN AND WHERE ARE TAX SALES CONDUCTED? 
Public Tax Sales may only be conducted on the first Tuesday of any month at the courthouse of the county in which the property is located. As to the specific time and location at the courthouse, you must refer to the published notice of sale in the newspapers referenced above. 

WHAT IS THE BIDDING PROCESS? 
There is no formal bidding process. Oral bids are made consecutively by whoever can raise the last bid made, the same as in auctions generally. All sales will be to the highest bidder. The officer begins by announcing the sale and the official minimum opening bid, and then asks for bidders. If you open the bidding by offering the minimum opening bid, then others may raise the bid. Then, you can decide whether you want to continue bidding against them by offering a higher bid(s). 

WHAT IS THE MINIMUM BID I SHOULD EXPECT TO PAY? 
The &amp;amp;quot;minimum bid&amp;amp;quot; varies from property to property. The exact minimum bid is determined by the officer conducting the sale prior to the sale, and is announced at the sale. Unless there are &amp;amp;quot;credits&amp;amp;quot;, you should expect to pay an amount that is the total of all amounts due in the judgment, penalty and interest, attorney fees, court costs, title costs, Constable/Sheriff fees, and posting fees. 

DOES YOUR LAW FIRM OFFER A FINANCING PROGRAM OR ANY DISCOUNTS? 
No. However, we may offer a payment arrangement plan for successful buyers of property at a Tax Sale for tax years not included in the judgment (i.e. taxes which accrue after the judgment). 

WHAT TYPE OF OWNERSHIP DOCUMENT IS ISSUED AT THE SALE? 
The successful bidder on a property will be issued a Constable's Deed or Sheriff's Deed within 4 to 6 weeks after the auction date. It is provided by &amp;amp;#167; 34.01(n) of the Texas Property Tax Code that: &amp;amp;quot;The deed vests good and perfect title in the purchaser or the purchaser's assigns to the interest owned by the defendant in the property subject to the foreclosure, including the defendant's right to the use and possession of the property, subject only to the defendant's right of redemption, the terms of a recorded restrictive covenant running with the land that was recorded before January 1 of the year in which the tax lien on the property arose, a recorded lien that arose under that restrictive covenant that was not extinguished in the judgment foreclosing the tax lien, and each valid easement of record as of the date of the sale that was recorded before January 1 of the year the tax lien arose. The deed may be impeached only for fraud.&amp;amp;quot; For further information regarding the meaning of this statutory provision, please consult your own attorney. If taxes have accrued against the property since the time of foreclosure judgment (i.e. &amp;amp;quot;post judgment taxes&amp;amp;quot;), the tax sale purchaser is considered by the taxing jurisdictions to have taken title subject to any such post-judgment taxes.

State Laws and Procedures

Texas Codes Annotated, Tax Code, Title 1, Chapter 32, &quot;Tax Liens and Personal Liability,&quot; Chapter 33, &quot;Delinquency,&quot; and Chapter 34, &quot;Tax Sales and Redemption.&quot;   The sale is to the highest bidder that is willing to tender an amount that is less than the lesser of the market value of the property as specified in the warrant or the total amount of taxes, penalties, interest, costs, and other claims for which the warrant was issued. (Sec. 34.01, Sec. 34.02). The owner of real property subject to sale may file with the officer charged with the sale a written request that the property be divided and that only as many portions be sold as necessary to pay the amount due against the property (Sec. 34.01i)

State Summary

Texas is a redeemable deed state and has the highest return of any lien or redeemable deed state at 25% per six months for non-homesteaded and non-agricultural properties. There are 254 counties in Texas. The larger counties have tax sales 4 times a year and counties with really large populations may even have a tax sale every month. Some counties also have over the counter deeds available. 



As with all other redeemable deed states, you must physically attend the tax sale, however Texas counties also require that you register in advance of the tax sale and have a bidders statement in order to participate in the tax sale. The bidders statement is a statement signed by the county assessor-collector attesting to the fact that you do not owe any county, municipal or school taxes in that taxing jurisdiction. Travis County requires that you request a bidders statement at least 5 days before the tax sale. Once you get a bidders statement from Travis County, it is good for 90 days. 



The Travis County tax collector also has a lot of good information on her web site for bidders including a due diligence guide, a video explaining the tax sale process, tax sale information, and tax sale lists. You can even sign up to receive notices of tax foreclosure sales by e-mail. The web site is at www.TravisCountyTax.org.



For most of the other counties the tax sales are handled by private law firms. Two law firms that conduct a lot of the Texas tax sales are Linebarger Goggan Blair &amp; Sampson, LLP and Perdue Brandon Fielder Collins &amp; Mott LLP. 



The redemption period is 2 years for homesteaded (owner occupied residential) and agricultural property, and 6 months for all other properties. The redemption penalty is 25% and the penalty is paid on the total amount paid for the deed, not just the minimum bid amount. The minimum bid consists of delinquent taxes, penalties and cost of the sale. All this makes Texas an excellent state for tax deed investing.



Successful bidders must pay in full at the time of the sale, or within a given time period; failure to do so will result in penalties of up to 25% of the value of the property plus the cost of resale. Personal checks, money orders, and cashiers checks (with proper ID) are accepted for payment; cash and credit cards are not.



All bidders must be registered before the sale. In order to bid for another person or entity, documentation of the bidder’s authority to do so must be presented to the officer conducting the sale. Purchasers will receive a “tax resale deed”, which is without warranty, and will have a legal right to the property during the redemption period. . For the smaller counties that do not require the bidder’s statement of no taxes owed before the sale, the purchaser must furnish a statement signed by the county tax assessor stating that the purchaser has no known delinquent taxes owed to the county or any of it’s taxing authorities within a couple of days of the sale. Since a property could be subject to different taxing authorities, such as the county, school district, or city, the purchaser may be responsible for additional tax liens as well as current taxes on the property.



Many Texas counties have tax information online, but to find information on the tax sale you will need to contact the legal firm that is handling the sale. You can get a lot of information tax sales for a lot of counties at the Linegarger Goggan Blair &amp; Sampson, LLP website at http://www.publicans.com/services/tx_tax_sales.htm, including tax sale lists for the regular tax sales, resales, and struck off  (over the counter) properties. The firm of Perdue Brandon Fielder Collins &amp; Mott LLP also has some information online at http://www.pbfcm.com/. 

Some of the larger counties will use both law firms and have more than one tax sale going on at the same time.
