County Process / Terms & Conditions

1.  You must register with the Hardin County Clerk at least 15 days (no later than July 26, 2010) in advance of the sale.  The sale date is August 09, 2010 beginning at 9:00 a.m.

 

o   The fee registration is $10.00 per bill with a cap of $250.00 (payable at time of registration)

o   You must sign and complete a registration form (which can be found on our website).  We will accept this form only by mail.

o   You must complete an affidavit (which can be found on our website) affirming that the purchaser is not related to any other individual or entity that will be participating in the sale.  The affidavit must be notarized.  If the purchaser is an entity, the purchaser shall provide the name of a contact person who can be reached at the address and phone number provided.  The affidavit must be submitted along with the registration form.

o   Each entity participating in the sale must have a separate representative.  One attorney cannot represent multiple entities in the lottery process.

 

2.  Fifteen business days (no later than July 26, 2010) prior to the sale date, 3rd party purchasers with prior year certificates will be permitted to submit lists.  These lists should be submitted electronically (MS Excel or Comma Delimited File) to debl.hcco@hcky.org.  Funds to cover these lists will be accepted by certified check only, which has to be received at the Hardin County Clerk’s office no later than August 02, 2010.  These lists will be to purchase 2009 bills for which you have priority to purchase due to prior year certificates of delinquency.  The list must include the following information:

 

o   Contact information for Assignment (company name, contact person, address and phone number)

o   Prior year certificate of delinquency tax year and tax bill number

o   2009 tax bill number

o   Parcel/MAP ID Number

o   Name on tax bill

o   2009 Total of Delinquency amount

o   Total of all certificates requested with August payoff (plus $46.00 which includes $28.00 assignment fee, $5.00 certification fee and $13.00 release fee) – you will be able to calculate the August payoff on our website starting July 12, 2010

 

The bills appearing on these lists will be prepared for assignment and removed from the actual lottery sale list prior to the sale.  The assignments will be completed in a timely manner no earlier than the date of the sale.        

 

  3.  Submission of Lists of Certificates for the LOTTERY SALE - the registration form shall be submitted to the Hardin County Clerk’s Office at least 1 week before the sale.  An electronic list of certificates (MS Excel or Comma Delimited File) that you are interested in purchasing at the sale shall be submitted listing the bills in priority order to debl.hcco@hcky.org.  The bills should be listed from the most desirable to least desirable.  The list should include the following information: 

 

o   Contact information for Assignment (company name, contact person, address and phone number)

o   2009 tax bill number

o   Parcel/MAP ID Number

o   Name on tax bill

o   2009 Total of Delinquency amount

o   Total of all certificates requested with August payoff (plus $46.00 which includes $28.00 assignment fee, $5.00 certification fee and $13.00 release fee) to calculate the August payoff on our website starting July 12, 2010

 

 

4.  The LOTTERY SALE in Hardin County will be conducted in the following manner:

 

o   Each entity will be assigned a number based on a drawing to determine the order of priority for the sale.  Each entity will be allowed to purchase bills in this order until all bills are sold.

o   Bills will be sold in lots of 5 for each round.

o   All funds must be paid by certified check or credit/debit card.

State Laws and Procedures

Kentucky Revised Statutes, Title IX, Chapter 91, Section 91.420 et seq., &quot;Collection - Tax Sale&quot; (Louisville); Title XI, Chapter 134, &quot;Payment, Collection, and Refund of Taxes.&quot;  Tax claims are sold to the purchaser who first offers to pay the full amount of the delinquent property taxes and fees (Sec. 134.450).

State Summary

The commonwealth of Kentucky is a lien state, and tax sales are the responsibility of the county sheriff’s office. The interest rate is 12% per annum and the redemption period is 1 year. The lien holder may pay subsequent taxes that will also receive interest of 12% per annum. It is difficult to find any information online about tax sales in Kentucky. Sometimes county and city governments are merged together, in which case the city or the county could be the collector of taxes. Tax collection and the conducting of tax sales could be the responsibility of the county sheriff, the city tax collector, or, in the case of Jefferson County, the county attorney. Procedures for Kentucky tax sales are unusual and unlike that in any other state. Tax sales are referred to as “tax bill sales,” because they are actually selling the tax bill.



Fayette County government is combined with that of Lexington City. They hold their tax sale once a year in March and publish their sale list both online and in the local newspaper. Bidding is by sealed bid on a first come, first served basis. If your bid is the first to arrive, you win the lien. Bids are for the amount due plus a 10% penalty, 10% sheriff’s fee and $14.00 for advertising. The interest rate is not bid down, the price of the lien is not bid up and the percent interest in the property is not bid down. There is really no competitive bidding! The competition is about being first to get your bid in. The bid must be submitted in writing and can be mailed, faxed, e-mailed, or brought in person to the Lexington-Fayette Urban County Government Division of Revenue.   



Although your bid can be submitted by mail, you or your representative must be present on the day of the sale to have your offer accepted and be issued a “certificate of delinquency” (the equivalent of a tax lien certificate).

The certificate of delinquency is filed with the county clerk within 14 days of the sale and then delivered to the purchaser. The holder of the certificate must notify the delinquent tax payer within 50 days of the lien held against his/her property; that it bears interest of 12% per annum and that, if the certificate is not paid, it will be subject to collection as provided by law. Certificates are assignable.



This system sounds great for investors, doesn’t it? But there is one catch. If the division of revenue receives bids totaling over $200,000.00 for the entire sale, then the sale is halted and the county buys all of the liens. Any liens not receiving bids can still be purchased by investors from the county clerk’s office, only now there is an added cost: a 20% county attorney’s fee and a 10% county clerk’s fee. If you purchase a certificate of delinquency from the county clerk, the certificate is assigned to you and you are responsible for collecting the amount due plus interest from the delinquent tax collector. 



If the lien is not redeemed within the 1-year redemption period, the lien holder may foreclose on the property. You are required to foreclose within 10 years of the expiration of the redemption period, or lose your investment. Foreclosure does not guarantee that you will get the property. The judge may rule that the property go to foreclosure sale, in which case the property will go to the highest bidder at the sale, and you will get paid on your lien.
